Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of ClaimStreet ("ClaimStreet", "we", "us"), including our website, publisher tools, and consumer deal pages (together, the "Service"). By using the Service, you agree to these Terms. If you use the Service on behalf of a business, you agree on that business's behalf and confirm you have authority to do so.

2. What ClaimStreet does

ClaimStreet is a platform that lets local publishers run deals on behalf of local businesses. Publishers create deal campaigns; consumers claim a deal and receive a unique single-use code; the business honors the deal in person. ClaimStreet provides the software. The deals themselves are offered by the publisher and the participating business, not by ClaimStreet.

3. Accounts

Publishers and their staff sign in with an email address and password and are responsible for keeping their credentials secure and for all activity under their account. Consumers access their claimed deals through sign-in links we email to them; you are responsible for keeping access to your email account secure. You must provide accurate information and be at least 18 years old (or the age of majority where you live) to create a publisher account.

4. Claiming and redeeming deals

Unless a deal says otherwise, each person may claim one code per deal. Codes are single-use: once a code is marked as used, it cannot be used again. Deals are available while supplies last, may carry expiration dates or other conditions shown on the deal page, and are honored by the participating business at its location. If a business declines to honor a deal, contact the publisher who ran it; we will help where we reasonably can, but ClaimStreet does not itself provide the goods or services being offered.

5. Paid deals and refunds

Some deals are purchased. Payments are processed by Stripe; ClaimStreet does not store your card details. Prices are shown before you pay. If a paid deal cannot be honored (for example, the business closes or the deal is voided before you use it), contact us and we will review a refund. Refunds are issued to your original payment method. Except where required by law, used codes are not refundable.

6. Publisher terms

Publishers are responsible for the deals they run: for having the advertiser's authorization, for the accuracy of deal descriptions, and for ensuring participating businesses honor claimed codes. Publisher subscription fees, free-tier limits, and the revenue share on paid deals are described in the product at the time you use those features. Payouts on paid deals are made through Stripe Connect to the publisher's connected account. We may withhold or reverse amounts to cover refunds, chargebacks, or suspected fraud. Fees and plan terms may change with reasonable notice.

7. Acceptable use

You agree not to misuse the Service. That includes: claiming or redeeming codes fraudulently or with automated tools; circumventing claim limits; running deals that are unlawful, deceptive, or that you lack rights to offer; interfering with the Service's operation or security; or attempting to access data that is not yours. We may suspend or terminate access for violations.

8. Content and intellectual property

Publishers keep ownership of the names, logos, and deal content they upload, and grant ClaimStreet a license to host and display that content to operate the Service. The Service itself, including its software and design, belongs to ClaimStreet, and these Terms do not grant you any rights in it beyond normal use.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that any particular deal will be available or honored.

10. Limitation of liability

To the fullest extent permitted by law, ClaimStreet will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amounts you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service if you violate these Terms or if we reasonably believe your use creates risk for us, other users, or third parties. Sections that by their nature should survive termination (including sections 8 through 12) survive.

12. Changes and contact

We may update these Terms from time to time. If a change is material, we will give reasonable notice, such as by posting on this page with a new "last updated" date or by email. Continued use of the Service after changes take effect means you accept the updated Terms. These Terms are governed by the laws of the United States and the state in which ClaimStreet is established, without regard to conflict-of-law rules.
